About
These terms govern the Perk Spend waitlist prize draw (the “Promotion”). By joining the Spend waitlist you enter the Promotion and agree to these terms. The promoter is Perk USA Inc., 251 Little Falls Drive, City of Wilmington, County of New Castle, Delaware 19808, USA (“Perk”). No purchase or payment is necessary to enter or to win, and the Promotion is void where prohibited by law.
We may amend or cancel the Promotion only where reasonably necessary due to fraud, technical failure, legal or regulatory requirement, or circumstances outside our reasonable control, and any such change will not materially disadvantage entrants who have already entered unless required by law.
How to enter
Register your company’s interest on the official Spend waitlist between 1 July 2026 and 31 August 2026. Entries received through any other channel, or outside that window, are not valid. There is a limit of one entry per company (a “company” means a single legal entity together with its parent, subsidiaries and affiliates, which count as one entrant). You are responsible for ensuring your entry is submitted on time. Your odds of winning depend on the number of eligible entries received.
Eligibility
This is a business-only Promotion. It is open only to bona fide businesses based in the United States, excluding businesses located in New York, Florida and Rhode Island, and is void where prohibited. It is not open to consumers or individuals acting in a personal capacity, and the prize is awarded to a company and cannot be awarded to or redeemed by an individual.
You may only enter on behalf of a business. By entering, the person submitting the entry confirms they are 18 or over, are an employee or representative of the entrant business, and are authorised to enter on its behalf and to bind it to these terms. Entries from free or personal email addresses, or that are not clearly made on behalf of a business, may be disqualified. The person entering must not be an employee, contractor or immediate family member of any Perk group company. We may verify eligibility, including the entrant’s business status, before releasing any prize.
How winners are chosen
We will select 10 winning companies at random from all eligible entries, and our decision is final. The draw will take place on or around 2 September 2026 and will be conducted by Perk using a randomised automated process. We’ll notify each winner by the email address given at entry. If a winner doesn’t respond by any deadline we set, or is ineligible, we may draw a replacement or leave the prize unawarded, without further liability.
The prize
Each of the 10 winning companies will receive a conditional promotional fee waiver (the "Prize"), on these conditions:
The Prize is a waiver of the first 6 months of Spend licence (subscription) fees, if the winning company elects to subscribe to Spend.
To redeem the Prize, the winning company must sign a Spend agreement or order form with Perk by 31 December 2026; once signed, the first 6 months of licence fees are free, running from the start of its paid subscription.
The waiver covers licence/subscription fees only — not transaction, card, FX, third-party, usage-based fees or taxes.
Winning does not guarantee immediate implementation; go-live follows Perk's standard onboarding.
Winning does not require or obligate the winning company to subscribe to or purchase Spend. If a winning company chooses not to sign a Spend agreement by 31 December 2026, the Prize will expire automatically and no substitute prize or cash alternative will be provided.
The Prize is non-transferable, has no cash alternative, and is offered as-is. The winning company is responsible for any taxes arising from receipt of the Prize.
Your data and publicity
By entering, you allow us to process the name, email and company details you provide to administer the Promotion. If you win, you agree we may publish your company name and state to anyone reasonably entitled to it on request. Further details on how personal data is processed can be found at www.perk.com/legal/privacy-policy under “Marketing”.
General
Everything in the Promotion, including the prize, is provided “as is”. To the fullest extent permitted by law, Perk is not liable for any loss arising from participation in the Promotion or use of the prize, and you agree to indemnify Perk against claims arising from your participation. If any provision is found unenforceable, the rest stands; our failure to enforce a term is not a waiver. Where the Promotion is facilitated by a social media platform, you release that platform from all liability and acknowledge it is not sponsored or endorsed by it. Participation is your full agreement to these terms and to Perk’s decisions, which are final.
Governing law
These terms are governed by and construed in accordance with the laws of the State of Delaware, whose courts shall have exclusive jurisdiction to settle any dispute arising out of or related to this Agreement.
